Terms of Use (TOU) — ESJC Radio

1. Purpose

The purpose of these Terms of Use (hereinafter "TOU") is to define the terms and conditions under which ESJC Radio makes its mobile application available to users, as well as the rights and obligations of each party.

4. Access Conditions

The application is accessible free of charge to any person with:

• A compatible mobile device (smartphone or tablet)
• An active Internet connection (Wi-Fi or mobile data)
• A supported operating system (recent versions of iOS or Android)

ESJC Radio reserves the right to change the technical conditions for accessing the service.

5. User Obligations

By using the application, the user agrees to:

• Use the application in strict compliance with applicable laws and regulations
• Not attempt to disrupt, degrade, or compromise the operation of the application
• Not reproduce, copy, or distribute content without prior authorization
• Not use the application for illegal, fraudulent, or immoral purposes

All elements composing the application (editorial content, logos, brands, texts, images, sounds, graphic interfaces, and source code) are the exclusive property of ESJC Radio or its partners and are protected by applicable intellectual property laws.

Any unauthorized reproduction, representation, modification, or exploitation of these elements is strictly prohibited and may be subject to legal action.

7. Service Availability

ESJC Radio strives to ensure the availability of the application 24/7. However, interruptions may occur for the following reasons:

• Planned maintenance: scheduled technical operations, announced whenever possible
• Technical incidents: unpredictable breakdowns or events beyond our control
• External causes: network interruptions, outages with operators or hosts

ESJC Radio shall not be held liable for the consequences of temporary service unavailability.

To the extent permitted by applicable law, ESJC Radio cannot be held responsible for:

• Interruptions or degradations related to the user's Internet connection
• Direct or indirect damages resulting from improper use of the application

The user may stop using the application at any time by uninstalling it from their device.

13. Applicable Law and Jurisdiction

These TOU are governed by and interpreted in accordance with Ivorian law. In the event of a dispute relating to the interpretation or execution hereof, the parties agree to seek an amicable solution before any legal recourse. Otherwise, the competent courts of Abidjan shall have exclusive jurisdiction.
